1. Agreement to Terms

By accessing or using the website, services, or software provided by GA Real Estate Consultants ("GAREC," "we," "us," or "our"), you agree to be bound by these Terms of Service (the "Terms"). If you do not agree to these Terms, you may not access or use the services. You affirm that you are 18 years of age or older and capable of entering into a binding contract.

2. Services Provided

GAREC provides a combination of professional real estate consultation services and a proprietary AI-driven software platform.

Consulting Services: Including, but not limited to, advising on buying, selling, leasing, property management, estate planning, and investment strategies.

Software Services: Provision of access to GAREC’s owned and white-label automation and management platforms ("The Software"), including tools for data management, lead tracking, communication, tenant screening, and reporting.

3. Disclaimers and Professional Advice

A. No Legal, Financial, or Tax Advice. GAREC, its agents, and its software are not providing legal, financial, or tax advice. Any information provided by our consultants or generated by our Software (including market analyses, profit projections, or estate guidance) is for informational and educational purposes only. You must consult with your own licensed legal, financial, or tax professional before making any real estate decisions.

B. Real Estate Risk. You acknowledge that all real estate transactions involve risk. GAREC makes no guarantee regarding the outcome of any transaction, investment, or property value.

C. No Broker-Client Relationship. Unless a separate, formal, written brokerage agreement (such as a Buyer Agency Agreement or Listing Agreement) is executed between you and GAREC, no broker-client relationship is formed by your use of this website or basic consultation.

4. User Accounts and Responsibilities

A. Account Creation. Access to The Software may require account registration. You are responsible for maintaining the confidentiality of your password and for all activities that occur under your account.

B. Accuracy of Information. You agree to provide accurate, current, and complete information when using our services (e.g., contact details, property information, financial history). Providing false or misleading information is a breach of these Terms.

5. Fees, Subscriptions, and Payments

A. Service Fees. Fees for Consulting Services (e.g., commissions) will be governed by a separate, signed service agreement.

B. Software Subscriptions. Access to The Software is offered on a subscription basis. You agree to pay all applicable fees as outlined on our pricing page or in your service contract. Fees are non-refundable, except as explicitly stated in a written agreement.

C. Termination of Service. We reserve the right to suspend or terminate your access to the Software or services for non-payment of fees or for any breach of these Terms.

6. Intellectual Property Rights

A. GAREC Intellectual Property. The website, The Software, all proprietary models, methodologies, algorithms (including the "AI technology"), designs, graphics, and underlying code are the property of GAREC or its licensors and are protected by intellectual property laws.

B. Restrictions. You may not copy, modify, distribute, sell, reverse engineer, or create derivative works of The Software or any proprietary content without GAREC's express written permission.

C. User-Submitted Data. By submitting data, comments, property listings, or testimonials ("User Content") to our site or Software, you grant GAREC a non-exclusive, royalty-free, perpetual, worldwide, transferable license to use, display, reproduce, and publish that User Content in connection with the operation of the GAREC business.

7. Communication and Privacy

A. Consent to Messages. By checking the consent boxes on our forms, you expressly consent to receive:

Transactional Messages: Including appointment reminders, service updates, and account notifications.

Marketing/Promotional Messages: Including special offers, discounts, and news (e.g., the RE Finance Monthly Newsletter).

B. Messaging Terms. You acknowledge that message frequency may vary and that Message & Data rates may apply. You can reply HELP for assistance or STOP to opt out of marketing messages.

C. Privacy Policy. Your use of our services is also governed by our Privacy Policy, which details how we collect, use, and protect your personal information.

8. Limitation of Liability and Indemnification

A. Limitation of Liability. To the maximum extent permitted by applicable law, GAREC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or related to your access to or use of the services, even if GAREC has been advised of the possibility of such damages. In no event shall GAREC’s total liability to you exceed the amount you paid to GAREC in the six (6) months preceding the claim.

B. Indemnification. You agree to indemnify and hold harmless GAREC from any claim, demand, damages, or costs (including reasonable attorneys' fees) arising out of or related to your breach of these Terms or your use of the services.

9. Governing Law and Dispute Resolution

These Terms shall be governed and construed in accordance with the laws of the State of Georgia, without regard to its conflict of law provisions.
